Client Security Board Approves Claims

ST. PAUL -- At its June 2006, meeting, the Minnesota Client Security Board approved payment of seven claims, in the total amount of $18,050, against three former lawyers.

The Board approved two claims against David L. McCormick in the total amount of $11,500.00.  McCormick last practiced law in Minneapolis, Minnesota.  He was suspended by the Minnesota Supreme Court in March 2006.

The Board approved four claims against Arne D. Anderson in the total amount of $4,950.00.  Anderson last practiced law in Duluth, Minnesota.  He was suspended by the Minnesota Supreme Court in April 2006.

The Board approved one claim against William C. Mortensen in the amount of $1,600.00.  The Board has now approved two claims against Mortensen in the total amount of $7,764.00.  Mortensen last practiced law in St. Louis Park, Minnesota.  He was placed on disability inactive status by the Minnesota Supreme Court in January 2006.

Also at its June meeting, the Board elected Michael T. Rengel, an attorney from Fergus Falls, as its Chair.  Mr. Rengel will serve as Chair until his term on the Board expires on June 30, 2007.  He has been a member of the Board since 2001.  Mr. Rengel is a MSBA nominated member and a shareholder at Pemberton, Sorlie, Rufer & Kershner PLLP in Fergus Falls.

The Client Security Fund is a fund established by the Minnesota Supreme Court to reimburse clients who suffer loss of money or other property from the dishonest conduct of their attorney.  The Fund is administered by a Board appointed by the Court, and consists of five lawyer members and two non-lawyer members.  All serve without compensation as a public service.

The Client Security Fund covers most situations in which lawyers have stolen clients' money or other property entrusted to them.  The Fund does not cover losses resulting from the malpractice or negligence of lawyers.

Definition:

Nolo contendere

Definition:
A Latin phrase meaning, "I will not contest it." A plea in a criminal case which does not require the defendant to admit guilt, but the defendant does not contest the facts on which the charge is based. Some judges refuse to accept such pleas in criminal cases.

Rest

Definition:
1) the person who is the subject of a petition, 2) the prevailing party in a court case against whom an appeal is taken.
