Statute of Limitations for California Legal Malpractice

California Law Revision Commission

The Commission is undertaking a comprehensive study of the statute of limitations for legal malpractice (Code Civ. Proc. § 340.6). The Commission has issued a tentative recommendation and a revised tentative recommendation. The comment period for the tentative recommendation is closed and the Commission has already considered those comments. Comments on the revised tentative recommendation are due by February 17, 2006.

The Commission has also been exploring whether Section 340.6 should be revised to address concerns raised by the State Bar Trusts and Estates Section regarding extended exposure to claims of estate planning malpractice and difficulty obtaining affordable malpractice insurance. In April 2004, the Commission referred this issue back to the State Bar for further consideration and development of a proposal that would be acceptable from the perspective of clients and beneficiaries, as well as estate planning attorneys.
